中国法院网讯 (邵平) 家住广东省四会市的卿女士近日遇上烦心事，自己借给朋友的价值180多万元的玉器逾期未能收回，并多次催讨无果，卿女士遂一纸诉状将朋友夫妇告上法院。近日，四会市人民法院对该案依法作出判决，判处两被告清还卿女士玉器款1815000元和利息。
卿女士和被告吴某是邻居，均在四会经营玉器生意，关系甚好。2012年9月8日，吴某提出向卿女士借玉器一批代为销售，双方立下借条：约定借货期为45天，如超期未归还玉器，按核定价值1815000元赔偿。一个半月后，卿女士多次催促吴某归还，但吴某却借口玉器已被骗走，玉器价值不足100万等理由不归还玉器，也不支付相应价款，而吴某妻子亦以其早已和吴某离婚为由，拒绝承担责任。卿女士一气之下将吴某夫妇诉上法院。
四会法院经审理认为，卿女士和吴某双方自愿签订出借玉器协议，且双方都同意核定的价值，因此出借协议和核定玉器价值的约定合法有效，双方应当按约履行。玉器出借之后借取人便负有对玉器的保护和交易安全的责任，玉器灭失或被别人骗走等情况与原告的出借行为没有因果关系，不能成为免责理由，因此被告吴某应承担相应的赔偿责任。虽然吴某夫妇已离婚，但离婚时间晚于借玉器的时间。按照婚姻法规定，离婚时原为夫妻共同生活所负的债务，应当共同偿还，因此吴某妻子也应当承担连带赔偿责任。据此，四会法院依法作出上述判决。
Until now, these small, snuffed-out galaxies were thought to grow into the larger quenched galaxies we see nearby.
As these galaxies are no longer forming new stars, they were thought to grow by colliding and merging with other smaller quenched galaxies some five to ten times less massive. However, these mergers would require many such small galaxies floating around for the quenched population to snack on -- which we do not see.
Until recently it had not been possible to explore a sufficient number of quenched galaxies, but now a team of astronomers has used observations from the Hubble COSMOS survey to identify and count these switched-off galaxies throughout the last eight billion years of cosmic history.
"The apparent puffing up of quenched galaxies has been one of the biggest puzzles about galaxy evolution for many years," says Marcella Carollo of ETH Zurich, Switzerland, lead author on a new paper exploring these galaxies. "No single collection of images has been large enough to enable us to study very large numbers of galaxies in exactly the same way -- until Hubble's COSMOS," adds co-author Nick Scoville of Caltech, USA.
The team used the large set of COSMOS images, alongside additional observations from the Canada-France-Hawaii Telescope and the Subaru Telescope, both in Hawaii, USA, to peer back to when the Universe was less than half its present age. These observations mapped an area in the sky almost nine times that of the full Moon.
The quenched galaxies seen at these times are small and compact -- and surprisingly, it seems they stay that way. Rather than puffing up and growing via mergers over time, these small galaxies mostly keep the size they had when their star formation switched off. So why do we see these galaxies apparently growing larger over time?
"We found that a large number of the bigger galaxies instead switch off at later times, joining their smaller quenched siblings and giving the mistaken impression of individual galaxy growth over time," says co-author Simon Lilly, also of ETH Zurich. "It's like saying that the increase in the average apartment size in a city is not due to the addition of new rooms to old buildings, but rather to the construction of new, larger apartments," adds co- author Alvio Renzini of INAF Padua Observatory, Italy.
This tells us a lot about how galaxies have evolved over the last eight billion years of the Universe's history. It was already known that actively star-forming galaxies were smaller in the early Universe, explaining why they were smaller when their star formation first switched off.
"COSMOS provided us with simply the best set of observations for this sort of work -- it lets us study very large numbers of galaxies in exactly the same way, which hasn't been possible before," adds co-author Peter Capak, also of Caltech. "Our study offers a surprisingly simple and obvious explanation to this puzzle. Whenever we see simplicity in nature amidst apparent complexity, it's very satisfying," concludes Carollo.

Aug. 1, 2013 — Two Michigan State University evolutionary biologists offer new evidence that evolution doesn't favor the selfish, disproving a theory popularized in 2012.
"We found evolution will punish you if you're selfish and mean," said lead author Christoph Adami, MSU professor of microbiology and molecular genetics. "For a short time and against a specific set of opponents, some selfish organisms may come out ahead. But selfishness isn't evolutionarily sustainable."
The paper appears in the current issue of Nature Communications and focuses on game theory, which is used in biology, economics, political science and other disciplines. Much of the last 30 years of research has focused on how cooperation came to be, since it's found in many forms of life, from single-cell organisms to people.
In 2012, a scientific paper unveiled a newly discovered strategy -- called zero-determinant -- that gave selfish players a guaranteed way to beat cooperative players.
"The paper caused quite a stir," said Adami, who co-authored the paper with Arend Hintze, molecular and microbiology research associate. "The main result appeared to be completely new, despite 30 years of intense research in this area."
Adami and Hintze had their doubts about whether following a zero determinant strategy (ZD) would essentially eliminate cooperation and create a world full of selfish beings. So they used high-powered computing to run hundreds of thousands of games and found ZD strategies can never be the product of evolution. While ZD strategies offer advantages when they're used against non-ZD opponents, they don't work well against other ZD opponents.
"In an evolutionary setting, with populations of strategies, you need extra information to distinguish each other," Adami said.
So ZD strategies only worked if players knew who their opponents were and adapted their strategies accordingly. A ZD player would play one way against another ZD player and a different way against a cooperative player.
"The only way ZD strategists could survive would be if they could recognize their opponents," Hintze said. "And even if ZD strategists kept winning so that only ZD strategists were left, in the long run they would have to evolve away from being ZD and become more cooperative. So they wouldn't be ZD strategists anymore."

Molex has introduced an industrial connector family that exceed IP67 and can be submerged in various fluids.
Called MX150L, it “supports low-level signals as well as power applications up to 40A”, said the firm. “Customers can choose from wire-to-wire, wire-to-panel and wire-to-board configurations and a wide range of wire styles and insulation thicknesses.”
Applications are expected in commercial vehicles, marine equipment and industrial equipment, particularly industrial power modules.
That said, not all automotive applications are covered.
“While MX150L connectors exceed IP67 requirements and conform to UL 1977, they are not designed for automotive applications with requirements such as USCAR-2, USCAR-25, GMW3191, AK Testing, J2030, Volvo Technology Requirements and Toyota Connector Spec [TCS], warned Molex.
Housings and terminal position assurance [TPA] components are pre-assembled and shipped in one piece
“The integral TPA provides a secondary lock to keep terminals in place and optional connector position assurance [CPA] components prevent accidental disconnection if the connector latch is depressed,” said the firm. To assemble, the appropriate terminal is crimped, inserted, then the TPA is engaged to its locked position “with no additional assembly steps required. Audible and tactile clicks on insertion, extraction and mating facilitate reliable mating and terminal loading and removal.”
The matt seal is a single silicone-based piece with individual wire openings, and a cap to protect, retain the seal as well as provide strain relief to the assembly.
Connections are based on 1.5 and 2.5mm blade-type terminals “which eliminate the need to purchase, handle and crimp individual wire seals and help reduce labour costs”, claimed Molex.
There are tools for high-volume production, low-volume production, and field repairs.

“Our revenue performance during the quarter reflected robust double digit sequential growth across all of our high performance mixed-signal (HPMS) end-markets with a strong rebound in growth in our Infrastructure & Industrial and our Portable & Computing business,” said Richard Clemmer, NXP Chief Executive Officer.
The chip firm’s ID and chipcard business saw strong ongoing demand in banking and transport markets.
“Our automotive business delivered strong sequential growth due to better than seasonal demand, combined with the launch of a new customer entertainment programme and the continued ramp of major keyless entry programmes,” said Clemmer.
The standard products business continues to disappoint with weaker than expected demand for certain logic products within the mobile end-market.
“The overall performance of HPMS is very good, with operating margin solidly within our long-term target, and we are comfortable delivering on our intermediate profitability goals,” said Clemmer.
NXP expects Q3 revenues to be in the range $1.24bn to $1.286bn.
Total debt at the end of the second quarter was $3.38bn, a $59m reduction from the prior quarter.
Cash at the end of the second quarter of 2013 was $569 million, resulting in a net-debt position of $2,812 million, a $33 million reduction from the prior quarter.
Fab utilisation was slightly down on a year ago at 90% in the second quarter, but better than in the prior quarter.

As of this morning, the spectrum allocated for 4G is cleared for action and O2 announced today that it will start a limited 4G service in three cities London, Bradford and Leeds on August 29th.
Vodafone, Three and BT, which also bought licences to use 4G spectrum five months ago, are still vague about the dates for launching their 4G services.
O2 says it will cover ten cities by the end of the year.
The spectrum licensed for 4G is in the 800MHz and 2.6GHz bands. It was bought by Vodafone, O2, Three, BT and EE.
However EE got a flying start when it got Ofcom’s go-ahead to use some of its existing 1800MHz spectrum, bought for 3G services, to launch a 4G service.
Vodafone is saying it will launch 4G services sometime in the summer, and Three is saying it will launch 4G services in Q4.
Analogue TV was broadcast over the spectrum which is now ready to be used by the wireless network companies.

60GHz wireless specialist, Blu Wireless has closed a $3.1 million funding round. This will allow the company to drive further growth, doubling in size to 30 staff, and complete the development of its HYDRA baseband IP offering for 802.11ad next generation WiFi (WiGig CERTIFIED) and 4G mobile network backhaul applications.
The funding round was led by Qi3 Accelerator, who represented a syndicate of over $1.5m (£1m) of London Business Angels private investors, including Wren Capital. A further $0.9 million (£0.6m) was invested by the Angel Co-Fund, several additional investors made up the remainder.
Blu Wireless’s baseband technology uses a flexible parallel processing architecture to efficiently support the complex modulation schemes required for emerging multi-gigabit wireless communication standards. The IP is currently optimised for chipsets used in both advanced WiFi and 4G small cell deployments, and can be simply scaled to support the anticipated future standards as they move to 20Gbps and beyond.
The Bristol, UK based firm is already working with several of the world’s leading semiconductor and system companies in these markets.
The IP will be sold under license agreement to chipset manufacturers that compete in, or want to enter, markets that exploit the unlicensed 60GHz frequency band.
Blu Wireless’s CEO, Henry Nurser commented: “With the completion of this funding round, we will be executing our plan to become the leading supplier of baseband system IP to manufacturers in the 60GHz sector.”

翡翠公盘指的是，由缅甸政府组织的翡翠原料拍卖会。公盘所对应的是私盘，指的是不由政府出面的私下买卖。这几年以来，缅甸政府不允许私下买卖翡翠原料，几乎所有的翡翠原料，都只能经由翡翠公盘拍卖销往国外。
翡翠公盘每年在仰光举行，一年有三四次。地点在缅甸宝石博物馆。每次公盘举行时，博物馆的大院里都摆满了翡翠原料。一般有一两千份料，一份料一个竞拍号，一个标的额。每份料有大有小、有多有少。
多的一份料由五六块上吨重的大料组成，这些料虽然大，可价格不高，一般也就几万元人民币。即使价格不高，买的人也不多，经常“溜标”剩下的就是这些原料。之所以便宜还没人买，是因为这些原料种干，透明度差，绿色很少。虽然大，但价值很低。这些就是行家们常说的“桩头料”，只能做一些大型摆件。但国内有些商家用这些原料加工成低档吊坠和手镯，平均一件成本也就几元钱，一般在旅游点销售，能卖到百元以上。
小的可能就是一块一手能拿过来的原料，甚至重不到一公斤。还别小瞧这不起眼的小料，竞争最激烈往往就是这些原料。如果有一条较宽的绿带，种水好，能出高档的戒面和花件，可能就能卖到几十万，甚至几百万元。
原料拍卖和国内大家常见的拍卖会不一样。国内的艺术品拍卖会，每个竞价人出的价格都是公开的，现场由拍卖师根据前一个出价人的价格统一加价。而原料拍卖却刺激得多，每个出价人都不知道别人的出价，完全靠自己的眼力，每个人都要算出自己能够接受的最高价格。如果高于这个价格，被别人买走了，也不觉得可惜，虽然他抢走了料，但很有可能赔钱呢，赔钱的买卖抢去也不心疼了。但由于不知道别人的出价，有时候会有出价最高的人，比出价第二的高出很多，虽然只多出一块钱，这块料就是你的，可你一下多出了一百万，虽然买了料，可也比较郁闷。
心理压力实在太大了。所以，买原料很少有一个人单打独斗的，一般总要几个人合伙，互相有个商议。但即使如此，也困难重重。
为了买到货，就要冒更大的风险。对行家来说，没有货就没有盈利的机会。但有时候，如果太冒险再加运气不够的话，就很有可能血本无归。
As the two inner stars whirl around each other, they periodically peek out from the disk that girds them like a hula hoop. The hoop itself appears to be misaligned from the central star pair, probably due to the disrupting gravitational presence of the third star orbiting at the periphery of the system. The whole system cycles through bright and faint phases, with the central stars playing a sort of cosmic peek-a-boo as the tilted disk twirls around them. It is believed that this disk should go on to spawn planets and the other celestial bodies that make up a solar system.
Spitzer observed infrared light from YLW 16A, emitted by the warmed gas and dust in the disk that still swathes the young stars. Other observations came from the ground-based 2MASS survey, as well as from the NACO instrument at the European Southern Observatory's Very Large Telescope in Chile.
YLW 16A is the fourth example of a star system known to blink in such a manner, and the second in the same star-forming region Rho Ophiuchus. The finding suggests that these systems might be more common than once thought. Blinking star systems with warped disks offer scientists a way to study how planets form in these environments. The planets can orbit one or both of the stars in the binary star system. The famous science fictional planet Tatooine in "Star Wars" orbits two stars, hence its double sunsets. Such worlds are referred to as circumbinary planets. Astronomers can record how light is absorbed by planet-forming disks during the bright and faint phases of blinking stellar systems, which in turn reveals information about the materials that comprise the disk.
"These blinking systems offer natural probes of the binary and circumbinary planet formation process," said Peter Plavchan, a scientist at the NASA Exoplanet Science Institute and Infrared Processing and Analysis Center at the California Institute of Technology, Pasadena, Calif., and lead author of a new paper accepted for publication in Astronomy & Astrophysics.
